BIOTIME Marketing Consent & Preferences

This document defines BIOTIME's optional marketing-consent and preference framework. Marketing consent is not required to purchase or use a BIOTIME Membership.

1. Purpose

BIOTIME may offer Members and prospective customers the option to receive marketing communications about BIOTIME products, services, events, promotions and recommendations. This document explains how those optional choices should operate.

2. Marketing Is Optional

A person is not required to agree to marketing in order to purchase a Membership, complete checkout, receive onboarding, access the Club, use MY BIOTIME or receive essential Member services.

3. Separate from Contractual Acceptance

Marketing consent must not be bundled into the mandatory Stripe checkbox used to accept the Membership Terms, Membership Particulars, Club Rules and Terms of Use. Declining marketing does not prevent completion of an otherwise eligible Membership purchase.

4. Separate from the Privacy Notice

The BIOTIME Privacy Notice is an information notice and is not itself a marketing-consent form. Where BIOTIME relies on consent for marketing, the consent choice is obtained separately and recorded.

5. Service Communications Are Different

Necessary transactional and service communications are not treated as optional marketing merely because they are delivered by email, LINE or SMS. These may include payment confirmations, receipts, onboarding, appointments, opening information, Membership status, safety notices, service interruptions, security messages and contractual notices.

6. Marketing Communications

Marketing may include promotions, additional Recovery offers, Personal Training offers, beverage or reward offers, Member events, new BIOTIME services, new Club locations, renewal campaigns, referral campaigns and recommendations concerning optional BIOTIME products or services.

7. Communication Channels

Where legally permitted and selected, marketing may be delivered through channels including LINE, email, SMS or other channels that BIOTIME later makes available. Consent or preference records should identify the applicable channel or scope where required.

8. LINE Marketing

BIOTIME may use LINE for both service communications and marketing. A Member who opts out of LINE marketing should continue to receive necessary LINE service messages where the relevant LINE functionality and applicable legal basis permit this separation. BIOTIME should configure operational and marketing message logic so far as technically practicable to respect the Member's preferences.

9. Email Marketing

Where email marketing requires consent or another applicable legal basis, BIOTIME will send marketing only where that basis exists. Marketing emails should provide an appropriate unsubscribe or preference-management mechanism where required.

10. SMS Marketing

Transactional SMS and promotional SMS should be distinguished. Marketing SMS will be sent only where BIOTIME has an appropriate legal basis and will provide an appropriate opt-out mechanism where required or technically applicable.

11. Scope of Consent

A marketing consent request should state clearly what the person is agreeing to, the types of communications covered, the relevant channels where appropriate, and that consent may be withdrawn. Consent should not be drafted as unlimited permission for unrelated processing.

12. Recommended Initial Consent

For initial implementation, BIOTIME should use a concise optional marketing choice covering BIOTIME offers, promotions, events and recommendations through the selected channel(s), with a clear link to the Privacy Notice and an explanation that withdrawal is available at any time.

13. Recommended English Consent Wording

Optional marketing consent: “I would like to receive BIOTIME offers, promotions, event updates and personalized recommendations through the communication channels I select. I understand that I can withdraw my marketing consent or change my preferences at any time.”

14. Channel Preferences

Where the user interface supports granular preferences, BIOTIME may allow separate choices for LINE, email and SMS. Where one combined consent is used, the interface should clearly identify the channels included and provide a practical way to later withdraw or adjust them.

15. No Pre-Ticked Optional Consent

Optional marketing consent should not be pre-selected. Silence, inactivity or failure to untick a pre-selected box should not be treated as affirmative marketing consent where consent is the relied-upon legal basis.

16. Evidence of Consent

Where BIOTIME relies on consent, BIOTIME should retain evidence including the person or Member identifier, consent status, exact consent wording, language, version, timestamp, source or channel, scope, and any subsequent withdrawal or preference change.

17. Withdrawal

A person may withdraw marketing consent at any time through available unsubscribe, preference, LINE, customer-service or other mechanisms. Withdrawal should be implemented without undue delay and should not affect processing lawfully carried out before withdrawal.

18. Preference Changes

A person may change selected marketing channels without necessarily withdrawing all marketing consent. BIOTIME should record the current preference and preserve an appropriate history of material consent changes.

19. Suppression Records

Where a person opts out, BIOTIME may retain limited suppression information necessary to ensure that the person is not inadvertently re-enrolled or contacted contrary to the opt-out, subject to applicable law.

20. Personalized Recommendations

Where BIOTIME uses Member information to personalize commercial recommendations, BIOTIME will assess the appropriate legal basis, transparency and data-minimization requirements. Sensitive health information should not be used for marketing personalization merely because it is available within Technogym/Mywellness.

21. Technogym Data

BIOTIME does not intend to import Technogym health, fitness, body-composition or workout datasets into its proprietary marketing database. Access to Technogym/Mywellness for training assistance does not by itself authorize use of those data for BIOTIME marketing.

22. Third-Party Marketing

Initial BIOTIME marketing consent should cover BIOTIME's own marketing, not unrelated marketing by third parties. If BIOTIME later proposes to share personal data with an independent third party for that party's own direct marketing, BIOTIME will separately assess the required notice, consent or other legal basis before doing so.

23. Advertising Audiences and Pixels

If BIOTIME later uses advertising pixels, conversion tools, custom audiences or similar advertising technologies, those activities must also comply with the applicable Cookie Policy, consent mechanism and privacy requirements. Marketing-message consent does not automatically constitute cookie or advertising-tracking consent.

24. Retention

Marketing-consent and preference evidence will be retained for as long as reasonably necessary to demonstrate the applicable permission, withdrawal and compliance history, including for an appropriate period after withdrawal where necessary to establish compliance or maintain suppression records.

25. Children and Minors

Standard BIOTIME Membership is for persons aged 20 or above. BIOTIME does not intend to seek standard Member marketing consent from minors. Any future marketing directed to younger persons would require a separate legal and privacy assessment.

26. Changes to Marketing Preferences Framework

BIOTIME may update the available marketing categories, channels or preference interface as services develop. A material expansion beyond the scope of an existing consent will not be treated as automatically covered where fresh consent or another legal basis is required.
